PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 22 May 2000, the applicant consulted with legal counsel, was advised of the impact of the discharge action, and submitted a statement in his own behalf. On 24 May 2000, Orders 145-003, DA, Camp Humphreys Transition Center, PSC 314, P.O. Box 4, APO AP discharged the applicant from the Regular Army, effective date: 1 June 2000. The record contains a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty) which was authenticated by the applicant’s signature. His DD Form 214 indicates that he was discharged under the provisions of Chapter 14, AR 635-200 by reason of misconduct-commission of a serious offense with a characterization of service of general, under honorable conditions. The specific facts and circumstances leading to the applicant’s discharge are not contained in the available records.

         b. On 1 June 2000, the applicant was discharged. At the time of discharge, the applicant had completed 2 years, 4 months, and 9 days of active military service.

Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l4 establishes policy and prescribes procedures for separating members for misconduct. Specific categories include minor disciplinary infractions, a pattern of misconduct, commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without leave. Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed. Army policy states that an under other than honorable conditions discharge is normally considered appropriate, but a general discharge under honorable conditions or an honorable discharge may be granted.

         a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

(1) The issue is rejected. The Board carefully examined the applicant’s record of service during the period of enlistment under review. The applicant’s record is void of facts and circumstances concerning events that led to a discharge from the Army. The applicant has submitted copies of several documents which show that he was separated under the provisions of chapter 14-12c, AR 635-200, for the commission of a serious offense, i.e., conspiring to commit assault upon another service member and making a false official statement. The Board noted that the applicant’s record also contains a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty) which was authenticated by the applicant. Paragraph 14-12c sets forth the procedures for separating individuals who commit serious offenses if the specific circumstances of the offense warrant separation. The applicant’s command determined that conspiring to commit assault and making a false official statement were serious offenses and that this misconduct warranted separation from the Army. In conjunction with separation under chapter 14-12c, the applicant was assigned the appropriate Separation Designator Code of “JKQ” for the commission of a serious offense, and the corresponding Reentry Eligibility (RE) Code of 3. In the absence of evidence to the contrary, the Board presumed government regularity in the discharge process. The Board, being convinced that the reason for discharge and the characterization of service were proper and equitable, voted to deny relief.
